Notice of Tort Claim Filed against Health and Welfare

A mental health care provider with seven offices in southern and eastern Idaho filed a multi-million dollar Notice of Tort Claim against the Idaho Department of Health and Welfare.

In the documents attached to this story, Seasons of Hope says they filed the claim because of the department and its employees "willfully... maliciously" and intentionally harmed Seasons of Hope and its owner, Heath Sommer.

The claim seeks 12 million dollars in lost business. Three million in general damages and $160,000 in unpaid payroll after its licensed was abruptly suspended. Read details of the claim in the attached documents with this story.

Meanwhile Seasons of Hope is still trying to get its provider license back so that the doors can re-open. In July, former district judge, Peter McDermott, ruled that the Department of Health and Welfare overstepped its bounds in investigating Seasons of Hope and revoking its provider license, effectively shutting down the business.

Health and Welfare is now appealing that decision. Briefs are still being prepared for the Health and Welfare director to make a final decision. That decision is still weeks away.

Maybe the Dept. will lose some of it's power that is commonly abused. I hope Seasons collects every penny.

such a tragedy for Seasons of Hope, a thriving, caring business in our community destroyed by Health And Welfares personal VENDETTA against Mr. Sommer and officials at Seasons. There,s your tax dollars at work, folks....
