After eight years, thousands and thousands of dollars in legal fees, and numerous copy-cats, Mecinna Price finally has a patent giving her the legal rights to her product:the DripStik.
Price’s invention features a Popsicle holder for two different sized Popsicle sticks, an ice cream cone holder, and an attachment that allows you to make your own Popsicle.
“I had seen a similar item that held dill pickles, and I remember thinking ‘Are there enough dill pickles consumed that we need a holder for them?’, but I knew we ate enough popsicles and ice cream cones,” she says.
The patent Price received is the second patent she has applied for; she’s still working with her lawyers to receive the first patent she requested in order to be entitled to money for copyright infringement.
“We’ve lost about 12 million dollars in the past six years of sales from customers of ours that are now buying the knock-off from China’s distributors,” she says.
Price says the patent is important to protect her invention from being manufactured by companies who create knock-offs and try to pass them off as her original product.
“In fact, the original packaging they had had my own children on it,” Price says. “They used the pictures off of my own web site that they cut and pasted onto the packaging to try to pass it off as my product.”
Some retailers even believe they’re buying directly from her when they’re really purchasing a copy.
“I think we talk about the American Dream as ‘come up with this idea, open this business and just do it, make it happen’, and it’s not all we crack it up to be. It’s a lot of work and it doesn’t always pay off,” Price says.
