Pocatello Police See Increased Use of E-Cigarettes among Teens

A warning now from the Pocatello Police Department regarding the possession and use of e-cigarettes by juveniles.

According to Idaho Code 39-5703, "Possession, distribution or use by a minor." (1) It shall be unlawful for a minor to possess, receive, purchase, sell, distribute, use or consume tobacco products or electronic cigarettes or to attempt any of the foregoing."

Lt. Paul Manning says police are contacting an increasing number of juveniles who are in possession of e-cigarettes. The use of this device still delivers nicotine into the body but does not have the smoke and odor commonly known to standard cigarettes. Juveniles are reporting to officers that they are able to purchase the e-cigarette devices in the Pocatello area.

According to Idaho Code 39-5705, "Sale or distribution of tobacco products and electronic cigarettes to a minor." (1) It shall be unlawful to sell, distribute or offer tobacco products or electronic cigarettes to a minor.

The Pocatello Police Department wants to remind and educate vendors of these devices that it is illegal to sell to minors.

Parents need to be educated about the law as it pertains to e-cigarettes. Juveniles found in possession, use, and/or distribution of these devices will be cited and referred to the Bannock County Juvenile Justice system.
