A struggle over a gun landed one man in the hospital with a gunshot wound to the leg.

Idaho Falls Police arrested Daniel Jesse Larsen, 24, for aggravated battery early Sunday morning.

Police were called to the 1200 block of Boise Avenue around 2:50 a.m. for a report of a shooting. Officers arrived and found that Mickey D. McMurtrey, 35, had been shot in the left thigh.

According to McMurtrey and witnesses, there were a few people at Larsen’s home for a party where they’d been drinking alcohol.

McMurtrey told police he saw another man become physically aggressive toward his wife and push her into a fence at the house. When McMurtrey tried to intervene, Larsen, holding a gun, tried to stop him.

McMurtrey and Larsen struggled over the gun and it went off.
